Terms of Service

1. Agreement
These Terms govern your use of the SpeedGuardian Pro application and website (the “Service”), operated by Make More Marbles (“we,” “us”). By downloading, installing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service is — and is not
SpeedGuardian Pro displays posted speed-limit information and related alerts to help you stay aware of speed limits while driving. It is an informational aid only. It is not a substitute for observing posted signage, obeying traffic laws, or exercising safe driving judgment, and it is not a navigation, radar-detection, or law-enforcement-avoidance product.
3. Driver responsibility
You are solely responsible for your driving at all times, including compliance with all speed limits, traffic laws, and licensing requirements. You agree to configure and interact with the Service only when it is safe and lawful to do so. When the app and a posted sign disagree, the posted sign is always right.
4. Data accuracy disclaimer
Speed-limit data is supplied by third-party map providers and may be incomplete, outdated, or incorrect — particularly on recently changed roads, in construction zones, in school zones with time-of-day limits, and in rural areas. Alerts may be delayed, inaccurate, or absent due to GPS conditions, network availability, device settings, or data gaps. You must not rely on the Service as your source of truth for any speed limit.
5. No warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY ALERT WILL FIRE AT ANY PARTICULAR TIME OR PLACE.
6. No liability for citations or driving outcomes
THE SERVICE DOES NOT GUARANTEE THAT YOU WILL AVOID SPEEDING CITATIONS, LICENSE POINTS, INSURANCE CONSEQUENCES, ACCIDENTS, OR ANY OTHER OUTCOME. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY FINES, PENALTIES, CITATIONS, LICENSE ACTIONS, INSURANCE PREMIUM CHANGES, ACCIDENTS, INJURIES, PROPERTY DAMAGE, OR ANY OTHER DAMAGES OR LOSSES ARISING FROM YOUR DRIVING OR FROM YOUR USE OF, OR RELIANCE ON, THE SERVICE.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; AND (b) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your violation of any law while using the Service, or your operation of a vehicle.
9. Subscriptions
Subscriptions are billed through your Apple ID. The 7-day free trial converts to a paid subscription unless cancelled at least 24 hours before the trial ends. Manage or cancel in iOS Settings → Apple ID → Subscriptions. Refunds are handled by Apple under App Store policy.
10. Acceptable use
Do not reverse-engineer, scrape, resell, or misuse the Service; do not use it in any way that takes your attention off the road; do not use it for any unlawful purpose.
11. Governing law
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Arizona.
12. Changes
We may update these Terms; continued use after an update constitutes acceptance. Material changes will be noted in the app or on this page.
